    State Prosecutors Appeal Sexual Assault Case Against Acquitted Naval Academy Midshipman, Seeking Mistrial on Additional Charges

    State prosecutors are appealing the sexual assault case against Garrett Lee Holsen, a midshipman at the Naval Academy acquitted of raping a classmate during an off-campus party.

    Holsen, 21, was found not guilty of second-degree rape in September following a six-day trial in Anne Arundel County Circuit Court. Though several witnesses testified that he had sex with a heavily intoxicated midshipman after the 2021 Herndon Monument Climb, a jury ultimately sided with Holsen, who said the woman didn't seem drunk and consented to the encounter.

    In a May 1 filing, the Office of the Attorney General asked the Appellate Court of Maryland to enter a mistrial for the second-degree assault and third-degree sex offense charges on which the jury did not render a verdict in September. During last year's trial, following an argument by defense attorney Peter O'Neill suggesting the counts were redundant, Anne Arundel Circuit Judge Robert Thompson ordered the jury not to seek verdicts for the two counts if they acquitted Holsen of rape.

    Following county prosecutors' objections to that decision, Assistant Attorney General Jer Welter will handle the state's case for the appeal. The attorney general's office declined to comment Thursday evening.

    Instead of O'Neill, who is a trial attorney, Holsen is being represented by Greenbelt attorney Megan Coleman.
